New Law Regarding DUI Suspension July 2013
As of July 2013, a person who is arrested for a first time DUI (no prior DUI’s) and who signs up for DUI School within 10 days of the arrest can get a hardship license immediately. They must go to a DMV hearing office within the 10 days with proof of signing up for the school in order to get the permit.
Before this change a person was immediately suspended and had to request a hardship hearing within the first 10 days. They could get a temporary permit until the hearing. If they won the hearing they got their license back, but if they lost they would have to go through a 30 or 90 day period of no driving whatsoever befoare getting a permit. This is a good option for first time arrestees and they should be made aware of it.
